IGNIFIT

Terms of Use

Effective date: October 4, 2026
Last updated: October 16, 2026

These Terms of Use (the "Terms") are an agreement between you and IGNIFIT, LLC, a Washington limited liability company ("IGNIFIT", "we", "us", or "our"). They govern your use of the IGNIFIT apps for iPhone, Apple Watch, Android, and Wear OS, available on the App Store and Google Play, including their widgets (together, the "App") and the website at igni.fit (the "Website", and together with the App, the "Services").

Please read these Terms carefully. By downloading, accessing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy, which explains how we collect and use your information. If you do not agree, do not use the Services.

If you live in the United States, Section 15 requires you to resolve disputes with us through individual binding arbitration and waives your right to a class action or jury trial, unless you opt out within 30 days as described in that section.

1. Eligibility

You must be at least 13 years old, or the minimum age required by the law of your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

2. The Services

IGNIFIT is an app for planning, recording, and analyzing strength training and other workouts. The Services let you, among other things, create workout plans and routines, record exercises and sets, use a rest timer and reminders, view charts, statistics, personal records, and awards, use weight and one-rep-max calculators, check in to gyms, read articles and watch videos, and export your workout records.

The Services are currently provided free of charge. We may change, add, suspend, or discontinue any part of the Services at any time. If we discontinue the Services, we will try to give you reasonable advance notice and an opportunity to export your data.

3. Health and Safety

The Services are not medical advice. The Services, including workout plans, exercise information, articles, videos, calculator results, statistics, and awards, are provided for general information and tracking purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and they are not a substitute for advice from a physician or other qualified health professional.

Strength training and other physical activity involve a risk of injury. To the extent permitted by law, you voluntarily assume the risks of any physical activity you undertake in connection with the Services.

4. Your Account

You can use the App without creating an account. If you create one, you may sign in with an e-mail address and password, a phone number, or a third-party sign-in service such as Apple, Google, X (Twitter), or Microsoft. Your use of a third-party sign-in service is also subject to that service's terms.

You are responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us immediately at support@igni.fit if you believe your account has been used without your permission.

You can delete your account at any time in the App under Settings > Delete Account, as described in our Privacy Policy.

5. Your Content

You own your content. "Your Content" means the information you enter in the Services, such as your workouts, sets, plans, routines, custom exercises, notes, and gyms. You keep all rights you have in Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as necessary to operate, provide, secure, and improve the Services for you, such as syncing it across your devices and calculating your statistics. This license ends when you delete Your Content or your account, except for copies kept for the limited periods described in our Privacy Policy.

You are responsible for Your Content and for making sure you have the right to enter it. You can export your workout records at any time under Settings > Data Export.

Feedback. If you send us suggestions, ideas, or other feedback, including through the in-app feedback form, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free right to use it for any purpose without obligation or compensation to you.

6. Sharing

The App lets you share charts, workouts, and other content to social networks and other apps, such as Facebook, Instagram, and X. Content you share is sent at your direction and is subject to the terms and privacy policies of the service you share to. You are responsible for what you share, and we are not responsible for how other services or people use it.

7. Acceptable Use

You agree not to:

8. Our Content and Intellectual Property

The Services, including the App's software, design, text, graphics, icons, bundled exercises, workout plans and routines, articles, awards, and the IGNIFIT name and logo, are owned by IGNIFIT or its licensors and are protected by copyright, trademark, and other laws.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control, as permitted by the rules of the app store from which you obtained the App, and to use the Services, for your personal, non-commercial use. You may not use our names, logos, or trademarks without our prior written permission. All rights not expressly granted to you are reserved.

9. Third-Party Services and Content

The Services include or link to services and content provided by third parties, such as Google Places (gym search and information), YouTube videos, articles from other websites, sign-in services, social networks, Apple Health and Health Connect (saving workouts recorded on your watch), and Typeform (feedback form). Your use of third-party services and content is subject to their own terms and privacy policies. We do not control and are not responsible for third-party services or content, and including or linking to them does not mean we endorse them.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, IGNIFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CALCULATIONS, STATISTICS, OR OTHER CONTENT WILL BE ACCURATE, OR THAT YOUR CONTENT WILL NOT BE LOST. WE RECOMMEND THAT YOU EXPORT YOUR WORKOUT RECORDS REGULARLY.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IGNIFIT AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, such as for death or personal injury caused by negligence, or for fraud. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless IGNIFIT and its members, managers, employees, and agents from any claims, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or of any law or the rights of a third party.

13. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services if you materially violate these Terms, if required by law, or if we discontinue the Services. Sections 3, 5 (Feedback), and 8 through 18 survive any termination of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If we make material changes, we will notify you in the App or by other appropriate means before the changes take effect. Your continued use of the Services after the changes take effect means you accept the updated Terms.

15. Dispute Resolution, Arbitration, and Class-Action Waiver

Please read this section carefully. If you live in the United States, it requires you and IGNIFIT to resolve most disputes through individual binding arbitration instead of in court, and it waives your right to participate in a class action or jury trial. You can opt out as described below.

Informal resolution

Before starting arbitration or any other proceeding, you and IGNIFIT agree to first try to resolve the dispute informally. The party raising the dispute must send the other a written notice describing the dispute and the relief requested, to support@igni.fit if sent to us, or to the e-mail address associated with your account if sent to you. If the dispute is not resolved within 60 days after the notice is received, either party may start arbitration.

Agreement to arbitrate (U.S. users)

If you live in the United States, you and IGNIFIT agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") will be resolved by final and binding individual arbitration, except as described under "Exceptions" below. The arbitrator, and not any court, has exclusive authority to resolve any Dispute about the interpretation, applicability, enforceability, or formation of this agreement to arbitrate, except that a court decides any Dispute about the class-action waiver below. This agreement to arbitrate is governed by the Federal Arbitration Act.

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at www.adr.org, as modified by these Terms. The arbitration will be conducted by a single arbitrator, in English, by video conference or written submissions unless the arbitrator decides an in-person hearing is necessary, in which case it will take place in the county where you live or in King County, Washington, at your choice. Payment of filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules, and if those fees exceed the amount you would pay to file a lawsuit in court, we will pay the difference. The arbitrator may award the same individual relief that a court could award, and judgment on the award may be entered in any court with jurisdiction.

Exceptions

Either you or IGNIFIT may (a) bring an individual claim in small claims court if it qualifies and remains there, and (b) seek an injunction or other equitable relief in court to stop the infringement or misuse of intellectual property rights.

Class-action and jury trial waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND IGNIFIT AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. If this class-action waiver is found to be unenforceable for any claim, then that claim, and only that claim, will be decided by a court as described under "Governing law and courts" below, and not in arbitration. YOU AND IGNIFIT EACH WAIVE THE RIGHT TO A JURY TRIAL.

Mass filings

If 25 or more similar demands for arbitration are filed against IGNIFIT by or with the assistance of the same law firm or organization within a 90-day period, the AAA's Mass Arbitration Supplementary Rules will apply, and the demands may be administered in batches as provided by those rules.

30-day right to opt out

You may opt out of this agreement to arbitrate by e-mailing support@igni.fit within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name, the e-mail address or phone number associated with your account (if any), and a clear statement that you want to opt out. Opting out will not affect any other part of these Terms. If we make a material change to this section, you may reject the change by sending us an opt-out notice within 30 days after the change takes effect, in which case the previous version of this section will continue to apply to you.

Governing law and courts

These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict of law principles. Any Dispute that is not subject to arbitration, including if you opt out of arbitration or live outside the United States, will be brought exclusively in the state or federal courts located in King County, Washington, and you and IGNIFIT consent to the personal jurisdiction of those courts.

If you are a consumer living outside the United States, the agreement to arbitrate and class-action waiver above do not apply to you, nothing in these Terms deprives you of the protection of the mandatory laws of your country of residence, and you may also bring proceedings in the courts of your country of residence where the law allows.

We respect the intellectual property rights of others. If you believe that content available through the Services infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) to our designated agent:

18. General

These Terms, together with our Privacy Policy, are the entire agreement between you and IGNIFIT regarding the Services and supersede any prior agreements. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
